TERMS AND CONDITIONS OF USE

INTRODUCTION

These terms and conditions ("Terms") govern your use of Kawartha Downs Casino's services, including the provision of slot machines at Kawartha Downs racetrack complex in Fraserville, Ontario.

AGE RESTRICTION

You must be at least 19 years old to enter our facilities and engage in gaming activities. We reserve the right to request proof of age from any person we reasonably believe is under 19 years old.

RESIDENTIAL ADDRESS AND IDENTITY

You represent that all information provided by you, including your residential address and identity documents (if requested), is true and accurate. You understand that providing false or misleading information may result in the termination of your account and/or prosecution to the full extent permitted by law.

SELF-EXCLUSION PROGRAM

We participate in the Ontario Lottery and Gaming Corporation's ("OLG") self-exclusion program, which allows individuals to voluntarily exclude themselves from participating in gaming activities at our facility for a specified period or permanently. You can access information about the self-exclusion program and apply to have yourself excluded by contacting OLG.

DEPOSIT LIMITS AND TIME-OUTS

You understand that deposit limits and time-outs are tools available through OLG's responsible gambling program, which you may use to limit your gaming activity or exclude yourself from our facilities for a specified period. You acknowledge that these tools are voluntary and may be used by contacting OLG.

SESSION REMINDERS OR LOSS LIMITS

We do not have the capability to send session reminders or loss limits on our slot machines, but we encourage you to use responsible gaming tools available through OLG's program.

We display and distribute information about provincial and national help services specializing in gambling-related harm, such as ConnexOntario and other Canadian support organizations.

ADDITIONAL RESPONSIBLE GAMBLING FEATURES AND POLICIES

Our facility is governed by strict responsible gaming policies that include monitoring of our patrons' behavior to prevent excessive or problem gaming activity. We reserve the right to restrict or exclude any patron we reasonably believe has engaged in or intends to engage in irresponsible gaming practices.

PRIVACY NOTICE

We respect your privacy and do not disclose personal information about you, except as permitted by law. You understand that providing us with personal information is necessary for the operation of our services and compliance with relevant laws.

LIMITATION OF LIABILITY AND WARRANTIES

WE DISCLAIM ALL WARRANTIES EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF OUR SERVICES, EVEN IF ADVISED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGE.

GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of Ontario and the federal laws of Canada applicable thereto. Any disputes arising out of or related to these Terms will be resolved through binding arbitration in accordance with the rules of the Canadian Arbitration Association, before a single arbitrator selected by us.

MODIFICATION OF TERMS

We reserve the right to modify or amend these Terms at any time without notice to you. Your continued use of our services after such modification shall constitute your acceptance thereof.

TERMINATION OF USE

We may terminate your access to our facilities and/or gaming activities at any time, with or without cause, in which case we will refund the value of any unutilized credits remaining in your account according to applicable provincial regulations.

ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and us with respect to their subject matter and supersede all prior negotiations, understandings, writings, discussions or communications by or between the parties regarding such subject matter.
